In the Consent Agreement, the EPA alleged that the Respondent violated RCRA by: (1) Operating A Hazardous Waste Treatment, Storage, and/or Disposal Facility Without a Permit, Interim Status, Or Valid Exemption to the Permitting Requirement; (2) Failing To Maintain Personnel Records; (3) Failing To Conduct Daily Hazardous Waste Tank Inspections; (4) Failing to Determine Whether Equipment Contains or Contacts a Hazardous Waste With 10% or More Organic Concentration; (5) Failing to Mark Equipment that Contains or Contacts Hazardous Wastes with Organic Concentrations of at Least 10 Percent by Weight; (6) Failing to Monitor Monthly Pumps and Valves that Contact Hazardous Wastes with Organic Concentrations of at Least 10 Percent by Weight for Leaks; (7) Accumulating of Universal Waste for Over One Year; (8) Failing to Store Universal Waste Lamps in Closed Containers; (9) Failing to Properly Label a Universal Waste Container; and (10) Failing to Demonstrate the Length of Time that Universal Waste Has Been Accumulating. As a result of these failures to comply with the requirements of the Pennsylvania Hazardous Waste Management Regulations, which incorporate the federal hazardous waste regulations promulgated under RCRA, Respondent is subject to the assessment of penalties under Section 3008(a) of RCRA. To resolve these alleged violations, Respondent will pay a penalty totaling $101,000. The Consent Agreement and Final Order initiate and resolve this enforcement action.
