Final Order With Penalty
Case summary
On June 11, 2026, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action against Umstott, Inc. (Respondent) for alleged violations of Subtitle I of the Resource Conservation and Recovery Act (RCRA) and the authorized West Virginia underground storage tank regulations, at Respondent's gas station and convenience store at 2 Mineral Street, Keyser, West Virginia. The alleged violations, occurring at various times from May 2022 through June 2025, include: (1) failure to conduct annual line tightness testing, (2) failure to conduct annual line leak detector testing, (3) failure to provide adequate spill prevention, (4) failure to conduct annual release detection system testing, (5) failure to conduct 30-day release detection monitoring, and (6) failure to conduct 30-day walkthrough inspections. Such violations frustrate the implementation of regulatory programs designed to prevent releases of hazardous waste and substances, a goal of RCRA. Respondent has agreed to pay a $31,000 civil penalty to settle the enforcement action. The EPA notified West Virginia in advance of this action and received no objection. This enforcement action is in support of Pillar 1 ( Clean Air, Land, and Water for Every American ) of the EPA's Powering the Great American Comeback Initiative.
