Case summary
On June 11, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA Subtitle I violations and violations of West Virginia's underground storage tank (UST) program by the Jefferson County Board of Education, as the tank owner and operator, of USTs at the Jefferson County Schools Transportation facility located at 754 Shenandoah Junction Road, in Junction, West Virginia. Region 3's RCRA Section of ECAD, in coordination with WVDEP, was able to resolve the UST violations of failing to perform walkthrough inspections at least every 30 days, as well as failing to have a Class A/B Operator designated for the facility for a period of time in 2025. The violations were discovered through an Off-Site Compliance Monitoring review that was initiated on October 8, 2025. The respondent has agreed to pay a $2,444 penalty and has returned to compliance with the violations.
