Case summary
In accordance with Section 122(i) of CERCLA, the EPA published a notice in the Federal Register for the Administrative Settlement Agreement and Order on Consent issued under Section 122(g) of CERCLA (EPA Docket No. CERCLA-03-2026-0157DC) at the Baghurst Drive Site, in Harleysville, Montgomery County, Pennsylvania. The public comment period closed on May 4, 2026, and EPA did not receive any comments on the settlement. On May 13, 2026, the settlement agreement was filed with the Regional Hearing Clerk and formal written notice of the filing and effective date ( May 13, 2026) sent to the Settling Party. The settlement agreement between EPA and Settling Party will resolve Settling Party of their liability under CERCLA as the current residential property owner. In exchange, the Settling Party will record an environmental covenant on their property, to implement the activity-and-use limitations for the Site selected in the Record of Decision (ROD) and provide EPA with long-term access for the remedial design and remedial action. EPA is conducting a remedial action to address contaminated groundwater at the Site. This supports Pillar One of EPA's Power the Great American Come Back- Clean Air, Water and Land for all Americans.
