Case summary

On May 27, 2026, EPA Region 3 issued three Administrative Order on Consents ( AOCs ) to Central Supply Company of West Virginia ( Central Supply ), the owner and operator of the concrete and builder supplies facilities located at 97 Hill Street, Mabscott, WV 25871 (the Mabscott Facility ); at 7900 Webster Road (WV Route 41), Summersville, WV 26651 (the Summersville Facility ); and at 130 Morgantown Industrial Park Road, Westover, WV 26501 (the Westover Facility ). The Mabscott Facility had 113 effluent limit exceedances for hexavalent chromium, aluminum, copper, iron, and total suspended solids; failed to maintain its Storm Water Pollution Prevention Plan (?SWPPP?); and failed to properly operate and maintain all facilities and systems of treatment and control. To return to compliance, within specified timeframes, Central Supply agreed to (1) provide an explanation of the procedures the Mabscott Facility takes or will take to ensure that all lab equipment is up-to-date and/or functional; (2) submit the calibration logs for the Mabscott Facility?s lab equipment for calendar year 2026; (3) provide a report that identifies and explains all the potential sources of pollutants that may be causing the effluent exceedances at the Mabscott Facility; and (4) provide a Corrective Action Plan that evaluates potential solutions for meeting effluent limits and a plan to implement the corrective actions at the Mabscott Facility. The Summersville Facility had 13 effluent limit exceedances for hexavalent chromium, aluminum, copper, iron, and total suspended solids; failed to practice good housekeeping and implement its SWPPP; failed to minimize or prevent any discharge; failed to properly operate and maintain all facilities and systems of treatment and control; failed to document sampling and/or retain records; and failed to properly post a permanent marker for Outlet 002. To return to compliance, within specified timeframes, Central Supply agreed to (1) provide an explanation of the procedures the Summersville Facility takes or will take to ensure that all lab equipment is functional; (2) provide documentation that it had completed specific cleanup actions at the Summersville Facility; and (3) submit specified Summersville Facility inspection logs for calendar year 2026. The Westover Facility had 8 effluent limit exceedances for iron; failed to submit a plan of action for aluminum at Outlet 001 by October 1, 2024; failed to practice good housekeeping and implement SWPPP; failed to properly conduct inspections and maintain inspection logs; failed to minimize or prevent any discharge; and failed to properly operate and maintain all facilities and systems of treatment and control. To return to compliance, within specified timeframes, Central Supply agreed to (1) provide documentation that it had completed specific cleanup actions at the Westover Facility; (2) submit specified Westover Facility inspection logs for calendar year 2026; (3) provide a report that identifies and explains all the potential sources of pollutants that may be causing the iron exceedances at the Westover Facility; and (4) provide a Corrective Action Plan that evaluates potential solutions for meeting iron limits and a plan to implement the corrective actions at the Westover Facility. Taking actions against such violations align with Pillar 1 of the Powering the Great American Comeback initiative. The EPA notified the West Virginia Department of Environmental Protection in advance of this action, and the Department had no objections.
