Case summary
On July 6, 2026, the Regional Judicial Officer issued a Final Order ratifying the Consent Agreement to commence and settle a penalty action to resolve alleged violations of the CWA against Real Alloy Recycling, LLC ( Real Alloy ) for failure to comply with NPDES Permit requirements at its aluminum recycling and alloy production facility, located at 238 Industrial Park Road, Friendly, West Virginia 26146 (the Facility ). The Facility was subject to a NPDES Multi-Sector General Water Pollution Control Permit, Permit Registration No. WVG610775. Violations alleged in the Consent Agreement include: failure to submit accurate discharge monitoring reports; failure to update the stormwater pollution prevention plan following benchmark exceedances; and failure to implement corrective action following benchmark exceedances. The settlement provides that Real Alloy will pay a penalty of $26,500. WVDEP is the NPDES permitting authority for operators of industrial stormwater discharges in West Virginia. EPA has consulted with West Virginia on the action against Real Alloy. This action supports Pillar 1 ( Clean Air, Land, and Water for Every American ) of EPA's Powering the Great American Comeback initiative.
