Case summary
On September 17, 2026, EPA Region 3 filed an Administrative Order on Consent (Order), that requires the Lower Lackawanna Valley Sanitary Authority (Respondent) to correct NPDES permit violations at the Respondent's facility located at 398 Coxton Road, Duryea, Pennsylvania 18642 (Facility). Based on observations made during an inspection on May 23 to May 25, 2023, the violations alleged include: multiple effluent limit exceedances during the period from December 31, 2020, to October 1, 2024; failure to provide required information in the Respondent's 2021, 2022, and 2023 Annual Reports; and failure to use the correct sensitivity for compliance analyses. Under the Order, the Respondent has agreed to undertake several corrective actions, including but not limited to the development of procedures for determining the cause of and responding to any future effluent limit exceedances, the submittal of quarterly reports of sample analysis data, and the implementation of an annual training program staff to refresh and enhance knowledge and awareness of permit requirements. The settlement is in support of Pillar 1 of EPA's Powering the Great American Comeback Initiative. EPA notified the Pennsylvania Department of Environmental Protection in advance of this action and received no objection.
