On June 15, 2026, Region 3 filed a Consent Agreement and Final Order (CAFO), simultaneously commencing and concluding an administrative enforcement action, against Action Manufacturing Co. for violations of RCRA C and the Pennsylvania federally authorized hazardous waste program at the precision ordnance products manufacturing facilities located at 500 Bailey Crossroads Road, Atglen, PA 19310 (the Atglen Facility ) and 190 Rittenhouse Circle, Bristol, PA 19007 (the Bristol Facility ). The violations alleged include operating without a permit or interim status at the Atglen Facility; failure to make hazardous waste determinations at the Bristol Facility; failure to keep containers of hazardous waste closed at the Atglen Facility; failure to provide annual review of hazardous waste training at the Atglen Facility; failure to have a complete contingency plan at the Atglen Facility; failure to submit the contingency plan to all local authorities at the Atglen Facility; failure to obtain written assessments by a qualified professional engineer for the tank system at the Atglen Facility; failure to inspect hazardous waste tanks daily at the Atglen Facility; failure to label a universal waste container at the Atglen Facility; and accumulation of universal waste for longer than one year at the Atglen Facility. Violations such as these can potentially lead to hazardous waste entering the environment which can be harmful to both human health and the environment. Taking actions against such violations aligns with Pillar 1 of the Powering the Great American Comeback initiative. The settlement requires Action Manufacturing Co. to certify that it is now in compliance with applicable hazardous waste requirements and to pay a $126,152.00 penalty. The EPA notified the Pennsylvania Department of Environmental Protection in advance of this action, and the Department had no objections.
