Case summary

On July 16, 2026, Region 3 filed a Consent Agreement and Final Order ( CAFO ), simultaneously commencing and concluding an administrative enforcement action against Denton Scrap Metal Recycling, LLC ( Respondent ), to resolve violations of the CWA at its auto salvage yard in Denton, Maryland. This CAFO now assesses penalties for those violations. In the Consent Agreement, the EPA alleged that the Respondent violated the CWA by: (1) failing to make necessary modifications or determinations in response to benchmark exceedances; (2) failing to properly document responses to benchmark exceedances; (3) failing to incorporate a complete location map into Stormwater Pollution Protection Plan (SWPPP); and (4) failing to ensure good housekeeping. As a result of these failures to comply with the requirements of the General Permit, issued pursuant to Section 402 of the CWA, Respondent violated Section 301 of the CWA. To resolve these alleged violations, Respondent will pay a penalty totaling $15,200. The Consent Agreement and Final Order initiate and resolve this enforcement action. This enforcement action supports Pillar 1: Clean Air, Land, and Water for Every American.
