EPA v. FIRST CHARLES TOWN GROUP, INC. (FIGGIE INTERNATIONAL SITE)

Case summary

On July 14, 2026, the administrative settlement agreement and order on consent ( ASAOC ) with potentially responsible party, First Charles Town Group, Inc. ( FCT Group), for performance of a removal action under CERCLA 104, 106, 107, and 122 at the Figgie International Facility in Ransom, Jefferson County, West Virginia ( Site ) became effective. FCT Group is the current owner of a parcel of the Site, which its predecessor, FCT Corporation, acquired in 1992. EPA's Removal Program conducted a Removal Site Evaluation ( RSE ) consisting of three rounds of indoor and sub-slab soil gas sampling of a building on the Site, owned by FCT Group, in December 2024, March 2025, and May 2025. Results of the RSE demonstrated exceedances of TCE concentrations in soil gas and indoor air. Prior to FCT Group's ownership, Figgie International owned the Site where it manufactured fire protection and safety equipment, furnishings, and other equipment. Figgie International was dismantled and its divisions were sold off throughout the early to mid-1990s. The ASAOC requires FCT Group to perform the response action selected in the October 31, 2025 Action Memo, including installation of a sub-slab depressurization system ( SSDS ) to remove elevated TCE vapor intrusion levels throughout the impacted building, SSDS pressure testing, installation of additional ventilation systems as needed, initial TCE air sampling starting one month after installation of the SSDS and additional ventilation sources, quarterly sampling inside the building for one full year, and adjustment and maintenance of the SSDS as needed.
