Case summary
On September 10, 2026, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle alleged violations of RCRA Subtitle I and Maryland's underground storage tank (UST) program by Montgomery Petro LLC as the owner and/or operator of the USTs at the Colonial Shell facility located at 4101 Randolph Road, Wheaton MD, 20906, Facility Identification Number 5322. Region 3's enforcement team, in coordination with MDE, was able to resolve the UST alleged violations of failure to annually test automatic line leak detectors, and failure to comply with financial responsibility requirements. The alleged violations were discovered as a result of an UST Compliance Inspection conducted on September 17, 2024. The respondent has agreed to pay a $4,446 penalty. By signing the agreement, the Respondent certified they had corrected the alleged violations. This activity furthers RCRA's purpose of promoting safe and effective handling and monitoring of Underground Storage Tanks in furtherance of the Administrator's Pillar #1 of providing every American with access to clean air, land, and water.
