Case summary
On February 9, 2026, Region 3 filed an Expedited Settlement Agreement ( ESA ), simultaneously commencing and concluding an administrative enforcement action against Christiana Care Health Services located in Newark, DE (the Facility ). The ESA was issued for alleged violations of RCRA Subtitle C and the Delaware Regulations Governing Hazardous Waste ( DeRGHW ). The alleged violations include: (1) Failure to label or mark universal waste batteries, (2) Failure to make a hazardous waste determination, (3) Failure to keep a hazardous waste container closed at all times, and (4) Failure to label its satellite accumulation containers with the words Hazardous Waste . This enforcement action furthers Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. The EPA notified Delaware Department of Natural Resources ( DNREC ) in advance of this action, and DNREC had no objections. Per the terms of the ESA, Christiana Care Health Services will pay a $5,000.00 civil penalty.
