Case summary

On October 23, 2025, EPA Region 3 filed an Administrative Order on Consent (Order), that requires Covestro LLC (Respondent) to correct violations of Section 301 of the CWA at the Respondent's facility located at 17595 Energy Road, Proctor, West Virginia 26055 (Facility). Based on observations made during an inspection on June 27 to June 29, 2023, the violations alleged include: multiple effluent limit exceedances during the period from October 31, 2021, to May 31, 2025; failure to submit discharge monitoring reports on multiple occasions between April 30, 2021, and February 28, 2025; failure to ensure compliance sampling is conducted in accordance with the Respondent?s permit; failure to ensure wastewater is properly drained from transport trailers before cleaning; failure to properly perform operation and maintenance of all facilities and systems of treatment and control; failure to submit prior notice to the West Virginia Department of Environmental Protection of a bypass at the treatment facility; and failure to maintain a stormwater pollution prevention plan. Under the Order, the Respondent has agreed to undertake several corrective actions, including but not limited to the development of procedures for determining the cause of and responding to any future effluent limit exceedances, annual audits of transport trailer cleaning activities, and the cessation of use of the Facility's boneyard area. The settlement is in support of Pillar 1 of EPA's Powering the Great American Comeback Initiative. EPA notified the West Virginia Department of Environmental Protection in advance of this action and received no objection.
