Case summary

On April 20, 2026, the Final Order was issued resolving EPA's allegations that Joy Recycling had failed to comply with NPDES permit requirements at its Kingwood facility at 438 Morgantown Street, Kingwood, West Virginia 26537, its Kerens facility at 120 Moon Run Road, Kerens, West Virginia 26276, and its Core facility at 4220 Mason-Dixon Highway, Core, West Virginia 26541. In order to operate its business at these facilities, Joy Recycling is required to obtain permit coverage from West Virginia to operate under West Virginia's Multi-Sector General Water Pollution Control Permit No. WV0111457. The alleged violations included Joy Recycling operating its business at times without such permit coverage, as well as Joy Recycling violating the permits once obtained. Alleged violations of the permits included: failure to review and revise the Stormwater Pollution Prevention Plan at Kingwood; failure to maintain good housekeeping at Kingwood, Kerens and Core; failure to take all reasonable steps to prevent or minimize a violative discharge at Kingwood; failure to post permanent outlet markers at Kingwood, Kerens and Core; failure to submit semi-annual discharge monitoring reports for Kerens; and failure to immediately report a petroleum product spill at Kingwood. The settlement requires Joy Recycling to pay a $1,500 penalty. This settlement is in support of Pillar 1 ( Clean Air, Land, and Water for Every American ) of EPA's Powering the Great American Comeback Initiative.
