The compliance issues addressed in the ESA involve the failing to accumulate as much as 55 gallons of hazardous waste or 1 quart of acutely hazardous waste in containers at or near any point of generation where wastes initially accumulate, which is under the control of the operator of the process generating the waste, failing to keep closed a container holding hazardous waste during storage, except when adding or removing waste from the container, failing to mark satellite accumulation containers with the words Hazardous Waste , and failing to maintain and operate the facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. The respondent has agreed to pay a $5,000 penalty and has returned to compliance with the violations.
