Case summary
On December 17, 2025, EPA Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action against Industraplate Corp. (Respondent) for violations of RCRA Subtitle C and the State of Delaware's federally authorized hazardous waste management program at the Respondent's facility located at 5 James Court, Wilmington, Delaware 19801 (Facility). Based on observations made during an inspection on April 23, 2024, the violations alleged include: operating a hazardous waste treatment, storage, and/or disposal facility without a permit, interim status, or valid exemption to the permitting requirement; failure to make a hazardous waste determination; failure to provide notification of a change in generator status; failure to provide an annual report for large quantity generators; and failure to submit and maintain land disposal restriction records. The settlement is in support of Pillar 1 of EPA's Powering the Great American Comeback Initiative. EPA notified the Delaware Department of Natural Resources and Environmental Control in advance of this action and received no objection.
