Case summary
On April 13, 2026, Region III entered into a Consent Agreement with, and issued a Final Order to, Nemours Childrens Hospital settling violations of RCRA Subtitle C that EPA inspectors observed during a Compliance Evaluation Inspection (CEI) at the company's facility in Wilmington, DE (Facility). The settlement will ensure that, in the future, the company will properly manage and identify hazardous waste at the Facility. During the CEI the inspector observed a deficiency in labeling and dating containers of hazardous waste and universal waste as well as inadequate aisle spacing in their central accumulation area. The facility also did not manage manifests from designated facilities and could not provide documents to the EPA at the time of the inspection. Nemours Childrens Hospital has agreed to pay a penalty of $7,500 to settle the enforcement action and refined its procedures for handling waste at the facility. The Consent Agreement and Final Order initiate and resolve this enforcement action. EPA informed DNREC of the action on September 5, 2025, and received no objection.
