Case summary

On April 20, 2026, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Sai Baba, Inc. located at 21 Tuscawilla Drive, Charles Town, West Virginia 25414 (the Facility ) for alleged violations of RCRA Subtitle I and the authorized West Virginia Underground Storage Tank Regulations. The alleged violations include: (1) failure to perform annual functionality testing; and (2) failure to perform release detection using line tightness testing or a monthly method. Such violations frustrate the implementation of regulatory programs designed to prevent releases of hazardous waste and substances, a goal of RCRA, and this enforcement action is in furtherance of Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. The EPA notified West Virginia in advance of this action, and West Virgina had no objections. Per the terms of the Consent Agreement, Sai Baba, Inc. will pay a $2,500 civil penalty, which was based on an analysis of its ability to pay.
