Case summary

On December 12, 2025, Region 3 filed an Administrative Order on Consent that requires Waste Management of West Virginia, Inc. (Respondent) to correct violations of the CWA at the Respondent's facility located at 7 Spring Street, Charleston, West Virginia 25302 (Facility). The Respondent is subject to a NPDES permit issued by the state of West Virginia. The alleged violations include: multiple effluent limit exceedances during the period from December 31, 2022, to June 30, 2025; failure to practice good housekeeping; and failure to conduct proper operation and maintenance to maintain all facilities and systems of treatment and control. Under the Order, Respondent has agreed to undertake corrective actions, including improving housekeeping and operations and maintenance along with exploring installing treatment, to eliminate effluent limit exceedances. The settlement is in support of Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. EPA notified the West Virginia Department of Environmental Protection in advance of this action and received no objection.
