Case summary
On January 26, 2026, Region 3 issued a CAFO to Gilbane Building Company (Gilbane) for a failure to comply with NPDES Permit requirements at the construction site, McMillan Slow Sand Filtration Site, located at 2700 North Capitol Street NW, Washington, D.C. 20002 (the Site). The Site was subject to a NPDES Construction General Permit, Permit No. DCR10009U (the Permit). Violations addressed in the CAFO include: failing to post permit coverage; failing to install and maintain sediment controls along perimeter areas downslope of exposed soil or disturbed areas; failing to minimize sediment track- out; failing to stabilize exposed portions of the site; failing to implement pollution prevention controls for building products, materials, wastes and washout; failing to document corrective actions; and failing to maintain an adequate Stormwater Pollution Prevention Plan ( SWPPP ). The settlement required Gilbane to pay a $39,500.00 penalty. The EPA is the NPDES permitting authority for operators of construction stormwater discharges in the District of Columbia and has consulted with the District of Columbia on the action against Gilbane. The settlement is in support of Pillar 1 ( Clean Air, Land, and Water for Every American ) of EPA's Powering the Great American Comeback Initiative.
