Case summary
On June 24, Region 3 issued two (2) Notices of Immediate Delivery Prohibitions to two (2) Express Mart facilities in Fredericksburg, VA under common ownership. The notices, referred to as Red Tags, are pursuant to RCRA Section 9012 of the Underground Storage Tank regulations. The Red Tags were affixed to the fill ports of the tanks by Virginia Department of Enviornmental Quality (VADEQ) staff at the request/direction of EPA, on June 25. The alleged violations include failure to utilize, maintain, test, and monitor release detection and overfill prevention equipment; designate and train operators; conduct walkthrough inspections; and demonstrate financial responsibility. Taking action against such violations aligns with Pillar 1 of the Powering the Great American Comeback initiative as it addresses access to clean air, land, and water. VADEQ was made aware of EPAs enforcement actions, had no objection, and assisted in the process.
