Case summary

On August 13, 2026, EPA Region 3 issued a First Amendment to an Administrative Compliance Order on Consent (Amended Order) to Strittmatter Materials, LLC (Strittmatter), the owner and operator of an electric powered crushing and screening plant located at 3334 Kenilworth Avenue in Hyattsville, Maryland ( Facility ). On September 29, 2025, the EPA issued an Order setting forth two (2) compliance alternatives for bringing the Facility into compliance with the New Source Performance Standards for Nonmetallic Mineral Processing Plants, codified at 40 C.F.R. Part 60, Subpart OOO (NMPP NSPS). Over the course of implementation of the September 29, 2025 order, Strittmatter determined that it was unable to comply with the terms of its chosen compliance alterative for operational reasons. The Amended Order, to be issued under the authority of Section 113(a) of the Clean Air Act, 42 U.S.C. ? 7413(a)(3), revises the terms of this compliance alternative such that Strittmatter will be able to comply and the EPA can be assured the Facility's secondary crusher will not operate above a throughput limit of 100 TPH, as if it was an in-kind replacement of a previous crusher. This case seeks to ensure that facilities that process nonmetallic minerals comply with applicable requirements in furtherance of the goal of providing clean air to every American.
