Case summary
On September 15 the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA Subtitle I violations and violations of Delaware's underground storage tank (UST) program by US Gas 2, LLC, as the tank owner and operator, of USTs at the US Gas #2 facility located at 505 Bay Road, in Dover, Delaware. Region 3's enforcement team, in coordination with DNREC, was able to resolve the UST violation of failing to conduct tank release detection on one of their USTs for six months in 2024. The violation was discovered through a UST Compliance Inspection conducted on January 22, 2025, and through follow-up information gathering. The respondent has agreed to pay a $1,222 penalty and has returned to compliance with the violations.
