Case summary
On June 9, 2025, the EPA Region 3 entered into a Consent Agreement and Final Order with Bold Realty, LLC resolving allegations that the company had violated the Toxic Substances Control Act and the Lead Disclosure Rule and Lead-Based Paint Renovation Repair and Painting Rule, codified at 40 C.F.R. Part 745, Subpart E, in connection with the leasing of nine (9) residential properties located in Pennsylvania. A February 20, 2025 joint-inspection with HUD revealed that at the time lease agreements were signed, Bold Realty, LLC failed to include a Lead Warning Statement in three (3) lease agreements in accordance with 40 C.F.R. 745.113(b)(1); and failed to include a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards, or disclosing lack of knowledge thereof in nine (9) lease agreements in accordance with 40 C.F.R. 745.113(b)(2). These TSCA requirements protect public health and the environment by protecting occupants of potential lead risks in residential properties. The Commonwealth of Pennsylvania was notified of this action. Under the Consent Agreement, Bold Realty, LLC will pay a civil penalty in the amount of Thirteen Thousand Four Hundred and Thirty-Six Dollars ($13,436) to settle the alleged violations.
