Case summary
On May 7, 2025, the Director of ECAD, Region 3 entered into an Administrative Order on Consent (AOC) with Marshall County Sewerage District (Respondent). The AOC alleges that the Respondent (1) between June 2019 and December 2024, experienced 432 effluent limit exceedances across eight permitted wastewater treatment facilities, which included fecal coliform, nitrogen, chlorine, copper, dissolved oxygen, total suspended solids, flow, and biological oxygen demand; and (2) from 2016 until 2024, failed to take representative composite samples, as required by its NPDES Permit, due to the absence of a working flow meter at one of its facilities. Under the terms of the AOC, the Respondent agreed to submit a Corrective Action Plan for EPA review and acceptance to address the effluent limit exceedances across all eight facilities and inflow and infiltration issues at one of the facilities. The EPA consulted with the West Virginia Department of Environmental Protection.
