Respondent is a major multi-state medical device manufacturing company based in Franklin Lakes, New Jersey. The CA was entered into, and the Final Order was issued, pursuant to 40 C.F.R. 22.13(b) and 22.18(b)(2) and (3) and RCRA 3008(a), 42 U.S.C. 6928(a). The CA documents the parties' agreement that the Respondent will pay a civil penalty of $12,612.00 as a result of specific RCRA violations, including: a) operating a treatment, storage, and disposal facility without a RCRA permit, RCRA Interim Status or valid exemption to the RCRA TSD permitting requirement and b) failure to conduct weekly hazardous waste inspections.
