Case summary
On May 5, 2025, Region III issued a Unilateral Administrative Order (UAO) to City of Chesapeake - Northwest River System for failure to comply with the requirements of Section 1433 of the Safe Drinking Water Act (SDWA), as amended by the America's Water Infrastructure Act (AWIA) of 2018. Section 1433 required PWSs serving over 3,300 people conduct a Risk and Resilience Assessment. It further requires a PWS to review its RRA at least once every 5 years and to submit to the EPA a certification that the PWS has reviewed and revised its RRA by the deadlines specified by AWIA. EPA issued the UAO to City of Chesapeake - Northwest River System because it had not complied with these requirements. EPA directly implements the Section 1433 requirements, but EPA has notified Virginia of the action against the facility.
