Case summary
On June 10, 2025, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against the Washington, D.C. Department of Corrections ( DC DOC ) located at 1901 E Street SE, Washington, D.C. 20003 (the Facility ) for alleged violations of RCRA Subtitle I and the authorized District of Columbia Underground Storage Tank Regulations. The alleged violations include: (1) failure to conduct release detection at least once every thirty days, (2) failure to perform walkthrough inspections at least once every thirty days, (3) failure to perform annual walkthrough inspections, (4) failure to perform piping release detection, (5) failure to conduct functionality testing of the overfill equipment, and (6) failure to maintain records of operator training. Such violations frustrate the implementation of regulatory programs designed to prevent releases of hazardous waste and substances, a goal of RCRA, and this enforcement action is in furtherance of Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. The EPA notified DCDOEE in advance of this action, and DCDOEE had no objections. Per the terms of the Consent Agreement, DC DOC will pay a $71,910 civil penalty.
