Case summary

On September 22, 2025, EPA Region 3 filed a Consent Agreement and Final Order ( CAFO ), concluding an administrative proceeding with Viant Collegeville, LLC ( Viant ) located at 200 West 7th Street, Collegeville, PA 19426 ( Facility ) for violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations, discovered during EPA's compliance inspection of the Facility on August 15-16, 2023. Under RCRA, EPA has authority to manage hazardous waste from cradle-to-grave including generation, transportation, treatment, storage and disposal of hazardous waste. Viant generated hazardous waste through the custom manufacture of small-diameter metal tubing for medical, industrial and military/government use. The violations in the CAFO include 1) operating without a permit or interim status, 2) failure to conduct a hazardous waste determination, 3) failure to maintain signed manifests at the Facility or file exception reports, 4) failure to provide RCRA training, 5) failure to maintain RCRA hazardous waste management documents, 6) failure to maintain the facility to prevent a release, 7) failure to maintain an adequate contingency plan, 8) failure to daily hazardous waste tank inspections, 9) failure to determine whether equipment contains or contacts a hazardous waste with 10% or more organic concentration, 10) storage of universal waste containers for over one year; and 11) failure to date or track storage of container of universal waste. Region 3 notified PADEP, which had no objections to this action. Per the terms of the CAFO, Viant will pay a civil penalty in the amount of $170,000.00. This action furthers Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for every American by protecting human health and the environment.
