Case summary

On June 9, 2025, a Consent Agreement and Final Order entered into by the EPA and Entegris, Inc. (Respondent) was filed with the Regional Hearing Clerk settling alleged violations of the CAA. The violations were discovered as a result of an investigation into activities at Respondent's specialty chemical manufacturing plant located at 800 W. Front Street in Chester, Pennsylvania (Facility) where it was determined that Respondent was at the time both subject to and in violation of the CAA and National Emission Standards for Hazardous Air Pollutants for Chemical Manufacturing Area Sources, codified at 40 C.F.R. Part 63, Subpart VVVVVV (Chemical Manufacturing NESHAP). Specifically, Respondent failed to submit a required notification of compliance statue and failed to keep required records as required by the Chemical Manufacturing NESHAP. Respondent has since represented and documented that it has submitted an application to the Pennsylvania Department of the Environment to include applicable provisions of the Chemical Manufacturing NESHAP into the Facility's state operating permit. This case seeks to ensure that facilities that utilize specific hazardous air pollutants in their process comply with applicable emissions and work practice standards, minimizing the risk of potential harm to neighboring communities and the environment in furtherance of the goal of providing clean air to every American. The parties reached an agreement on a civil penalty of $55,421 to address Respondent's violations and the Consent Agreement and Final both initiates and resolves EPA's administrative civil penalty claims. In keeping with our goal to work with our Agency partners, Pennsylvania has been notified of this action and has not raised any objections.
