Case summary
On May 1, 2025, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Nova Petroleum Suppliers LLC for RCRA I and D.C. federally authorized underground storage tank program violations at the 12th Street Shell facility located at 3701 12th St. NE, Washington, D.C. 2001 (the Facility ). The Facility is a fueling station, and it has four tanks. The violation alleged is the failure to operate and maintain the corrosion protection system to continuously provide corrosion protection for all four tanks. Violations such as these can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. Taking action against such violations aligns with Pillar 1 of the Powering the Great American Comeback initiative as it addresses access to clean air, land, and water. The settlement required Nova Petroleum Suppliers LLC to certify that it is now in compliance with applicable UST requirements and to pay a $30,230.00 penalty. The EPA notified the District of Columbia Department of Energy and Environment in advance of this action, and the Department had no objections.
