Case summary

On April 16, 2025, Region 3 entered into a Consent Agreement with, and issued a Final Order to, through the use of an Expedited Settlement Agreement (ESA), Univation Technologies LLC; settling violations of RCRA Subtitle C that EPA inspectors observed during an inspection of the company's organometallic catalyst manufacturing facility in South Charleston, WV (Facility). The settlement will ensure that, in the future, the company will monitor each valve in hazardous waste light liquid service for volatile organic compounds leaks on a monthly basis. The Company has agreed to pay a penalty of $5,000.00 to settle the enforcement action and refined its procedures for handling waste at the facility. The Consent Agreement and Final Order initiate and resolve this enforcement action. EPA informed WVDEP of the action by electronically submitted letter on January 30, 2025, and received no objection.
