Case summary
On May 14, 2025, Region 3 entered a Consent Agreement and Final Order with Norfolk Southern Railway Company ( NSRC ) that initiated and resolved alleged violations of the CAA and its implementing regulations related to remanufactured locomotives. The violations arise out of NSRC placing into service certain remanufactured locomotives that were not covered by an EPA-issued Certificate of Conformity or applicable exemption, or that did not comply with applicable emissions standards by failing to have idle controls installed. Such violations frustrate the implementation of regulatory programs designed to reduce emissions of harmful air pollutants, a goal of the CAA, and this enforcement action is in furtherance of Administrator Zelden's Pillar 1: Clean Air, Land, and Water for Every American. NSRC will pay a penalty of $299,000 within 30 days of the Effective Date. The settlement required NSRC to certify compliance with applicable CAA requirements. PADEP was provided notice of the planned enforcement action and had no objections.
