EPA v. WEIRTON AREA WATER BOARD

Case summary

On August 28, 2025, EPA, Region 3 issued an Administrative Order on Consent ( AOC ) to Weirton Area Water Board ( Weirton ), a community water system located at 125 E Bellview Drive, Weirton, West Virginia, 26062, alleging violations of the SDWA at its community water system, PWS Identification Number WV3300516. This enforcement action furthers EPA s First Pillar and the SDWA's goal of protecting the quality of the nation's drinking water. Weirton's violations included: (1) failure to provide an overflow pipe of sufficient diameter, (2) failure to provide an overflow with a proper air gap and splash plate, (3) failure to maintain plant facilities and critical assets, (4) failure to replace or regenerate the media used for filtration, (5) failure to be equipped with a self-contained breathing apparatus, (6) failure to provide secondary containment for chemical storage containers, (7) failure to ensure the overflow for the tanks open downward, and (8) failure to repair and maintain the overflow pipe on finished water structure. The EPA ordered Respondent to: (1) provide overflows that open downward and are screened with 24-mesh corrosion resistant screens on storage facilities (2) repair and maintain the overflow pipes for storage facilities so the overflow is of sufficient diameter (3) provide an air gap that is between 12-14 inches above the ground (3) remedy the corrosion on critical assets (4) be equipped with a self-contained breathing apparatus or other national Institute for Occupational Safety and Health approved respiratory equipment on site (5) provide an overflow pipe that provides an overflow that meets regulatory requirements (6) construct a secondary containment structure for the ferric chloride tank, fluoride, polyphosphate, and caustic bulk storage containers and (7) replace or regenerate the media used for filtration. EPA notified the West Virginia Department of Health and Human Services of the action.
