Case summary
On April 15, 2025, Region III filed a Consent Agreement and Final Order regarding eighty-three (83) violations of FIFRA in connection with the distribution and/or sale of misbranded pesticides that did not have the required first aid statement on the immediate containers and were sold at a time when the company's website contained false or misleading statements regarding the pesticides safety. This enforcement action furthers FIFRA's purpose of promoting the safe and effective use of pesticides in furtherance of the Administrator's Pillar of providing every American with access to clean air, land, and water. EPA became aware of the unlawful sale and distribution of these pesticides through an unannounced inspection. The Consent Agreement alleges that Quip Laboratories, Inc. violated FIFRA and EPA?s Pesticide Program regulations by failing to include the required first aid statement on the immediate containers and by making false or misleading statements on its website regarding the pesticides safety. Under the terms of the settlement, Quip Laboratories, Inc. will pay a civil penalty in the amount of $119,544.00 to resolve these eighty-three (83) violations. EPA notified the Delaware Department of Agriculture regarding this matter, and the Delaware Department of Agriculture has raised no objections.
