Case summary

On January 23, 2025, EPA Region 3 filed an Expedited Settlement Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Eastmain Performance Film, LLC ( Eastman ) located at 345 Beaver Creek Drive, Martinsville, Virginia 24112 ( Facility ) for violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Commonwealth of Virginia Hazardous Waste Management Program, discovered during EPA's compliance evaluation inspection of the Facility on July 23, 2024. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave. This includes the generation, transportation, treatment, storage and disposal of hazardous waste. To that end, EPA develops regulations, guidance and policies that ensure the safe management and cleanup of solid and hazardous waste, and programs that encourage source reduction and beneficial reuse. Eastman manufactures window film for the automotive and architectural industries. Hazardous waste is generated through its manufacturing activities. The violations in the settlement include failure to label containers with hazardous waste, having an open container of hazardous waste while waste is neither being added or removed, failure to mark hazardous waste containers with the accumulation start date, failure to provide annual refresher training, failure to maintain an updated contingency plan, and storing universal waste longer than a year. Region 3 notified VADEQ, which had no objections to this action. Per the terms of the Expediated Settlement Agreement, Eastman will pay a civil penalty in the amount of $7,500.00.
