Case summary

On November 20, 2024, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Kingsbury, Inc. { Kingsbury ) located at 10385 Drummond Road, Philadelphia, PA 19154 (the Facility ) for alleged violations of RCRA Subtitle C and the authorized Pennsylvania Hazardous Waste Management Regulations. The alleged violations include: (1) operating without a permit or interim status, (2) failure to submit a Biennial Report, (3) failure to notify PADEP of change in generator status, (4) failure to provide RCRA training, (5) failure to maintain RCRA training documents, (6) failure to maintain an adequate contingency plan, (7) failure to keep containers of hazardous waste closed, (8) failure to properly label a container of universal waste, and (9) failure to date or track storage time of a universal waste container. The Facility is not in an area of potential EJ concern. The EPA notified PADEP in advance of this action, and PADEP had no objections. Per the terms of the Consent Agreement, Kingsbury will pay a $64,600 civil penalty.
