Case summary
On October 22, 2024, EPA Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Sims ARG, Inc., (Respondent) the operator of the facility located at 15000 Southlawn Lane, Rockville, Maryland, 20850 (Facility), for alleged violations of RCRA Subtitle I, and the State of Maryland's federally authorized underground storage tank program. The Facility was inspected by EPA on January 5, 2023. The settlement will ensure that the underground storage tanks (USTs) at the Facility are properly managed and monitored regularly for leaks and that the Facility is in compliance with the Resource Conservation and Recovery Act (RCRA) and the federally authorized Maryland underground storage tank program. The violation in the settlement is the failure to provide adequate release detection. Respondent has agreed to pay a penalty of $9,084.00 to settle the enforcement action. The Facility is not in an area of potential Environmental Justice concern. EPA informed the state of Maryland of this enforcement action and received no objection.
