Case summary
On January 21, 2025, Region 3 entered into a Consent Agreement and Final Order with three operators at an 18-acre mixed development site in southeast Washington, D.C.: Skyland Holdings, LLC ( Skyland ), Lidl US Operations, LLC ( Lidl ) and Teel Construction, Inc. ( Teel ) for unpermitted construction stormwater discharges. The Skyland Holdings construction site is located at 2626 Naylors Road SE, Washington, DC, 20020. From at least March 24, 2022, until August 18, 2022, none of the operators had coverage under the NPDES Construction General Permit for construction activities while Teel built the Lidl grocery store on the site. The construction of the grocery store was part of a Common Plan of Development as defined in Appendix A of the 2022 NPDES Construction Stormwater Permit ( CGP ). The Consent Agreement requires the Respondents to pay a total civil penalty of $39,500.01, with each party paying a third of the penalty ($13,166.67 each). The DC Department of Energy & Environment is being kept informed of this enforcement matter.
