Case summary
On November 25, 2024, EPA Region 3 entered into a Consent Agreement with, and issued a Final Order to, through the use of an Expedited Settlement Agreement (ESA) with Huntington Plating, Inc. settling violations of RCRA Subtitle C. The facility in Huntington, WV is an industrial equipment electroplater. During an on-site inspection, EPA determined that the Facility violated the hazardous waste regulations by storing hazardous waste in containers which were not properly labeled, dated, or closed. Additionally, the Facility failed to: minimize the possibility of a release of hazardous waste, maintain land disposal restriction forms, and post emergency contact information in required areas. Region 3 notified West Virginia, which had no objections to this action. Per the terms of the ESA, Huntington Plating, Inc. will pay a civil penalty of $5,000 and demonstrate compliance with regulatory requirements. The Facility is located in an EJ sensitive area.
