Case summary

On September 22, 2025 the Regional Judicial Officer executed a Final Order ratifying the Consent Agreement entered into by the Director of ECAD and the City of Keyser ( Respondent ) for violations of its NPDES permit (NPDES Permit # WV0024393) effluent discharge limitations at the City of Keyser's Wastewater Treatment Plant ( WWTP ) located at 881 Waxler Road, Keyser, WV (the facility ). The Facility discharges from its wastewater treatment plant into the North Branch of the Potomac River. Violations identified at the Facility include several exceedances of effluent limitations, failing to report monitoring data on multiple occasions, and failing to properly operate and maintain the WWTP. Under the terms of the settlement, Respondent has agreed to pay a civil penalty, based on an ability to pay analysis, in the amount of $2,500.00 to settle the alleged violations in accordance with the terms and conditions set forth in the Consent Agreement and Final Order. Consent Agreement and Final Order initiates and concludes this penalty action.
