Case summary
On September 26, 2024, EPA Region 3 entered into a Consent Agreement and Final Order with Big Idea Group Realty, Inc. d/b/a Big Realty Property Management ( Respondent ) to resolve allegations that Respondent violated the Lead Disclosure Rule ( LDR ) under 40 C.F.R. Part 745, Subpart F. Respondent owns and operates a property management firm located in Schwenksville, Pennsylvania. On October 19, 2023, an EPA Inspector conducted a LDR inspection at Respondent's place of business and requested lease agreements for target housing (housing built pre-1978) which Respondent acted as an agent for. Based on the information received, EPA determined that at the time the lease agreements were entered into, Respondent violated TSCA by failing to comply with the requirements of the LDR. This TSCA requirement protects public health and the environment by promoting the disclosure of potential lead-based hazards in target housing. A property at issue was in an Environmental Justice Community of Concern. The Commonwealth of Pennsylvania was notified of this action. Under the Consent Agreement, Respondent will pay a civil penalty in the amount of $10,590 to settle the alleged violations.
