On September 30, 2024, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Hazleton Oil and Environmental, Inc. (Hazleton) relating to its Hazleton, PA facility for alleged violations of the RCRA and the authorized Pennsylvania Hazardous Waste Management Regulations. Hazleton performs waste oil recycling at its facility. The violations in the settlement include: (1) Operation without a hazardous waste permit or interim status; (2) Failure to make a hazardous waste determination; (3) Failure to properly maintain and operate a facility; (4) Failure to obtain a written assessment by a professional engineer for hazardous waste storage tanks; (5) Failure to provide hazardous waste tank system with secondary containment; (6) Failure to conduct daily inspections of hazardous waste tank system; (7) Failure to perform weekly inspections of hazardous waste container storage area; and (8) Failure to properly manage universal waste lamps. The facility is not in an area of potential EJ concern. Region 3 notified PADEP, which had no objections to this action. Per the terms of the Consent Agreement and based on its ability to pay a penalty, Hazleton will pay a civil penalty of $23,897.55.
