Case summary

On August 29, 2024, Region III filed a Consent Agreement and Final Order regarding five (5) violations of FIFRA in connection with the distribution and/or sale of misbranded pesticides and pesticides with a composition different from its EPA registration. This enforcement action furthers FIFRA's purpose of promoting environmentally safe and effective pesticide use and prevents the potentially harmful use of pesticides. EPA became aware of the unlawful sale and distribution of these pesticides through an inspection conducted by the Pennsylvania Department of Agriculture. The Consent Agreement alleges that North Industrial Chemicals, Inc. violated FIFRA and EPA's Pesticide Program regulations by failing to include proper directions for use and the correct composition of its registered pesticide Sodium Hypochlorite Solution (EPA Reg. No. 4197-1). Under the terms of the settlement, Plant Cell Technology, Inc. will pay a civil penalty in the amount of $41,600.00 to resolve these five (5) violations. EPA notified the Pennsylvania Department of Agriculture regarding this matter, and the Pennsylvania Department of Agriculture has raised no objections.
