EPA v. APPALACHIAN POWER COMPANY, INC. (HUNTINGTON SERVICE BUILDING)
Final Order With Penalty
Case summary
On August 1, 2024, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Appalachian Power Company for RCRA I and West Virginia federally authorized underground storage tank program violations at the UST facility located at 1122 7th Avenue, Huntington, WV 25701 (the Facility ). The Facility is a fueling station for employees of Appalachian Power, which provides power services to eleven states. At the Facility there are two USTs. The violations alleged include failure to report a suspected release for one UST to West Virginia within 24 hours, failure to immediately investigate and confirm a suspected release by an UST within seven days, and failure to monitor an UST for releases at least every 30 days. Violations such as these can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The settlement required Appalachian Power to certify that it is now in compliance with applicable UST requirements and to pay a $9,187.00 penalty. The Facility is located in an area of potential EJ concern. EPA notified the West Virginia Department of Environmental Protection in advance of this action, and the Department had no objections.
