Case summary

On September 30, 2024, Region 3 entered into a RCRA 7003 Administrative Order on Consent (AOC) with the US Department of the Navy (Respondent) for Parcel E of the former Southeast Federal Center, located in Washington, DC (Facility). In May 2024, Respondent acquired the Facility in a federal-to-federal land transfer from the General Services Administration. The AOC provides that Respondent will implement EPA's selected remedy for the Facility as selected in the EPA's Final Decision and Response to Comments (FDRTC) dated July 29, 2015. The FDRTC requires contaminated soils to be excavated and disposed offsite, and the implementation of a groundwater use restriction prohibiting potable use of groundwater at the Facility. The EJSCREEN assessment indicates that the Facility is located in an area of potential EJ concern as primary EJ Indexes within the one-mile radius is at or near the 80th percentile in the nation and the state.
