Case summary

On March 01, 2024, EPA Region III entered into a Consent Agreement and Final Order with Pallet Machinery Group, Inc. ( Respondent ) alleging violations of FIFRA and implementing Pesticide Program regulations promulgated at 40 C.F.R. Parts 150 -189, Subchapter E, in connection with the distribution and/or sale of various unregistered and misbranded pesticides known collectively under the name of Woodlock BioShield. This enforcement action furthers FIFRA's purpose of promoting environmentally safe and effective pesticide use and prevents the potentially harmful use of pesticides. In December 2019, EPA received a tip concerning the sale and distribution of pesticides in violation of FIFRA which was followed by producer establishment inspections conducted in May of 2023. On August 4, 2023, EPA issued a Notice of Potential Violation and Opportunity to Confer. The Consent Agreement alleges that Respondent violated FIFRA and EPA's Pesticide Program regulations by selling and distributing Woodlock BioShield with pesticidal claims, without the product being registered under FIFRA, as well as with labels and labelling lacking required information and containing false and misleading claims. The negotiated penalty for the violations of FIFRA alleged in the Consent Agreement is One Hundred Twenty Thousand Dollars ($120,000). FIFRA registration violations are exempt from EJ. EPA notified the Virginia Department of Agriculture and Consumer Services.
