Case summary
EPA R3 issued an Administrative Order for Compliance on Consent ( Order ) under Section 309(a) of the Clean Water Act ( CWA or Act ), 33 U.S.C. 1319(a) to the City of Petersburg for alleged violations related to the operation of the City's Municipal Separate Storm Sewer System ( MS4 ). The AOC requires the City of Petersburg to submit certain documents to EPA and implement certain activities in order to meet the requirements of the National Pollutant Discharge Elimination System ( NPDES ) General Permit for Discharges of Stormwater from Small MS4s, Permit No. VAR040013. The Order has been signed by the City and is currently in e-concurrence for signature. EPA has consulted with the Virginia Department of Environmental Quality ( VADEQ ) during the inspection and the development of this action, and EPA will email a copy of the fully-executed Order to the appropriate VADEQ representative. An EJSCREEN was run for Petersburg, and the area was flagged for a potential EJ concern. Twelve (12) of the thirteen (13) State Supplemental EJ Indexes were at or above the 90th percentile and seven (7) of the thirteen (13) Nation Supplemental EJ Indexes were at or above the 90th percentile. Finally, Seven (7) of the eight (8) socioeconomic indicators exceed the state average including the people of color and/or low income population(s).
