Case summary
On September 26, 2024, the Regional Judicial Officer executed a Final Order ratifying the Consent Agreement entered into by the Director of ECAD and the City of Salem ( Respondent ) for violations of its NPDES permit (NPDES Permit # WV0020257) effluent discharge limitations at the City of Salem Wastewater Treatment Plant ( WWTP ) located at 229 W. Main Street, Salem, WV (the Facility ). The Facility discharges from its wastewater treatment plant into Salem Fork, a tributary to the Monongahela River. Violations identified at the Facility include ninety-one (91) exceedances of effluent limitations, failing to submit inflow and infiltration reports, sending sludge to landfill that was less than 20 percent solids, and routinely treating more flow than the Facility was designed to treat. Under the terms of the settlement, Respondent has agreed to pay a civil penalty in the amount of $25,000.00 to settle the alleged violations in accordance with the terms and conditions set forth in the Consent Agreement and Final Order. The EJSCREEN assessment indicates that the Facility is not located in an area of potential EJ concern. This Consent Agreement and Final Order initiates and concludes this penalty action.
