Case summary

On April 25, 2024, the Director of the Enforcement & Compliance Assurance Division of EPA Region 3 issued an Administrative Order on Consent ( AOC ) to Shifflett's Used Auto Parts, an automobile salvage yard, to address industrial stormwater NPDES permit violations at its facility located at 724 Gorsuch Road Westminster, MD 21157 (the Facility ). The cited violations include (1) failure to maintain adequate Stormwater Pollution Prevention Plan (SWPPP) map, (2) failure to document routine facility inspections, (3) failure to ensure good housekeeping, (4) failure to maintain proper operation and maintenance, and (5) failure to define all outfalls. The Facility agreed to: (1) construct a covered vehicle disassembling area, (2) submit completed inspection forms quarterly, (3) submit progress reports including corrective actions taken, and (4) submit a written Standing Operating Procedure and BMP plans for vehicle dismantling at the facility. The Facility is not in an area of EJ concern. None of the supplemental EJ Indexes are at-or-above the 90th percentile in the nation or in the state for the area. EPA has consulted with MDE during the development of this action.
